Terms and Conditions
§ 1 Scope of application
These General Terms and Conditions (hereinafter “Terms”) apply to all contracts between Julia Paluszko, trading as “Hundeleicht Hamburg” (hereinafter “Trainer”), and her clients regarding the Trainer’s offerings, such as individual training, online training, group classes, and other services. The version of the Terms valid at the time the contract is concluded shall be decisive.
§ 2 Subject matter of contract
2.1 The subject matter of the contract is the provision of knowledge about dogs, their behavior, and appropriate training and management measures. The services include, in particular, individual training, group courses, social walks, online counseling, and other formats that are published and described on the website or in other ways, or that are agreed upon individually.
2.2 This contract is a service contract pursuant to § 611 of the German Civil Code (BGB); a specific (training) outcome is not guaranteed.
§ 3 Contract conclusion
The contract is concluded upon the customer’s registration (verbally, in writing, or via the online booking tool) and confirmation by the Trainer. For online bookings, the customer is given the opportunity to view and save the Terms before completing the booking.
§ 4 Scope of Services
4.1 The type, scope, and duration of the training services offered in each case are specified in the respective offer.
4.2 Delays on the part of the customer are at the customer’s own expense and do not entitle the customer to a reduction in payment.
4.3 The Trainer may change training locations and times on short notice for organizational or other reasons; in doing so, the Trainer will ensure that such changes are reasonable for the clients.
§ 5 Appointment policies
5.1 The client may cancel individual training sessions, online consultations, initial consultations, training services, and similar individual offerings no later than 24 hours before the appointment. For cancellations made later than this or in the event of a no-show, the full fee will be charged.
5.2 Courses, group sessions, and social walks that take place on fixed dates may be canceled free of charge up to 14 days before the course begins. If the customer cancels between 13 and 7 days before the course begins, a fee of 50% of the course price will be charged. If canceled later than 7 days before the course begins, the full course fee will be charged. If the customer is unable to attend individual sessions of the course, there is no entitlement to make up the missed sessions or receive a refund for them.
5.3 When booking training packages, individual sessions may be used within a specific time period as specified in the offer. If the booked sessions are not used during this period, they expire and are non-refundable.
5.4 The Trainer reserves the right to cancel events for professional, organizational, or financial reasons beyond its control. If the Trainer cancels an event or a training session, the Trainer will notify customers in a timely manner and, at the Trainer's discretion, either refund the fee paid or offer an alternative date. For individual canceled group sessions, an online session may serve as a full replacement.
§ 6 Customer obligations
6.1 The customer warrants that the dog is properly registered with the authorities, has received the necessary or veterinarian-recommended vaccinations, and is covered by valid liability insurance. Upon request by the Trainer, the customer must provide appropriate proof of registration with the authorities, vaccination status, and liability insurance.
6.2 The customer shall inform the Trainer in advance of any existing medical conditions, parasitic infestations, heat cycles, and behavioral issues, particularly aggressive behavior and anxiety. In the event of medical conditions or behavioral issues, the Trainer may exclude the dog from group sessions and, if necessary, reschedule individual sessions.
6.3 The client agrees to handle the dog in such a way that no other dogs, people, or property are endangered. During training, the client must follow the Trainer’s instructions. The dog must be kept on a leash during training; letting the dog off the leash is permitted only after consultation with the Trainer and at the client’s own risk.
6.4 The Trainer may exclude clients or dogs from training if behavior contrary to animal welfare is exhibited, if contractual obligations are breached in a non-trivial manner, if the client’s behavior endangers other people or dogs, or if health reasons reasonably preclude participation.
§ 7 Termination by the Trainer
The Trainer may withdraw from the contract for good cause; in such cases, any fees already paid shall be refunded to the client. Good causes include, among others, force majeure, the Trainer’s illness, an insufficient number of participants, unsuitable weather conditions, conduct by the client that violates the contract, or if the client jeopardizes the training objective through his or her conduct.
§ 8 Right of withdrawal
8.1 There is no right of withdrawal for this contract if it concerns a recreational activity and a specific date or time period is scheduled for the provision of the service (§ 312g (2) No. 9 BGB).
8.2 In all other respects, a statutory right of withdrawal applies to contracts concluded outside of business premises and to distance contracts.
§ 9 Liability
9.1 Participation in training sessions and group activities is at the dog owner’s own risk, or at the risk of the person accompanying the dog to the activity. The dog owner is liable for all personal injury, property damage, and financial loss caused by his or her dog in accordance with § 833 of the German Civil Code (BGB).
9.2 The Trainer is liable only for damages resulting from intentional or grossly negligent conduct. This does not apply to damages resulting from injury to life, limb, or health, or from a breach of material contractual obligations.
9.3 The Trainer is not liable for the conduct of other participants or third parties.
§ 10 Renumeration and terms of payment
10.1 The currently valid prices are listed on the website or in the Trainer’s public offer. Payment may be made in cash, by bank transfer, or via the payment services provided on the website.
10.2 Unless otherwise agreed, invoices must be paid within 7 days. The Trainer reserves the right to require advance payment for certain services prior to the start of the service.
§ 11 Copyright
All documents, scripts, training materials, and media provided by the Trainer to clients are protected by copyright. Distribution or publication is permitted only with written consent.
§ 12 Data protection
Personal data is processed exclusively for the purpose of contract fulfillment and in accordance with statutory data protection provisions.
§ 13 Final provisions
13.1 German law applies. In the case of contracts with consumers, mandatory consumer protection provisions of the country in which the consumer has his or her habitual residence remain unaffected.
13.2 Should any individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
